The auction will be held on Thursday 18 January 2024, starting at 11:00 a.m. CEST at the headquarters of Bertolami Fine Art S.r.l. in Piazza Lovatelli, 1 - Rome.

1. How to participate
The following methods of participation are envisaged: in person at the premises where the auction will be held, by telephone, online after registering on our website www.bertolamifineart.com or on our partner portals (see list below), by sending a written offer by 10:00 CEST Thursday 18 January 2024.

a. Participation in the room
Customers who are not known and who have not already registered must have a valid identity document.

b.Telephone participation
It is possible to bid during the auction by telephone guided by one of our operators. To access this method of participation, it will be necessary to book by 10.00 CEST on Thursday 18 January 2024 specifying the lots for which you intend to participate in the tender and a telephone number. Customers booked in this way will be called to the telephone number indicated by them a few lots before those for which they have expressed interest

c. Online participation through our website or partner portals

d.Participation by written offer
Finally, it is possible to formulate one's offers in writing by filling in the appropriate offer form by proxy or also via free text Offer form
Written offers must be received by Bertolami Fine Arts by 10.00 on Thursday 18 January 2024 and can be sent by e-mail (amministrazione@bertolamifineart.com – info@bertolamifineart.com), by post or delivered to our offices of Piazza Lovatelli 1 – 00186 Rome. The written offer has the value of authorization for the auctioneer to make offers on behalf of the signatory.

The lots will be on display from 15 to 17 January at the following times:

3.Pre-auction offers
The following methods of participation are envisaged for pre-auction offers:
- online or on partner portals until 10:00 CEST on Thursday 18 January 2024
- by means of a written offer formulated in the appropriate form. The duly completed form must be received by 10:00 CEST on Thursday 18 January 2024. The following methods of transmission are accepted: via email at amministrazione@bertolamifineart.com or info@bertolamifineart.com, by fax on 0039 063230610, by post or delivery to our offices.
Bids lower than the starting price are not accepted.
In the case of:
- single pre-auction offer on one lot
and in the absence of re-launch offers during the auction, the lot will be awarded at the auction base even if the only offer received is for a higher amount (the amount of the pre-auction offer in fact indicates the maximum offer that the bidder is willing to carry out)
Example: starting price €1,000 – Single pre-auction offer €1,500 – Awarding €1,000
- multiple pre-auction bids of the same amount on the same lot
and in the absence of relaunch offers during the auction, the lot will be awarded to the author of the offer with an earlier date
- multiple pre-auction offers of different amounts on the same lot
and in the absence of re-bids during the auction, the lot will be awarded to the author of the highest bid at a clearing price calculated by adding to the amount of the immediately lower bid a pre-established increase in the table published below (Table A )
Example: customer A bid €1,270, customer B bid €1,800. Customer B wins not at the hammer price of €1,800 but at €1,370. In other words, the automatic increase of €100 envisaged by the table is applied to the amount of the offer immediately below it when the offers are included in the €1,000-1,999 bracket.

4. Terms of payment
Buyers of the winning lots may choose from the following payment methods
- bank cheque or non-transferable bank draft made payable to Bertolami Fine Art s.r.l. (in the case of payment by foreign cheque add € 10 to the invoice amount)
- credit card (Visa, MasterCard and American Express);
- Paypal
- Bank transfer in favour of Bertolami Fine Art S.r.l.
(in the case of payment by non-European bank transfer add €10 to the invoice amount)
Please note: Invoices paid by cheque, cash or bank transfer are exempt from payment of the 3.5% administrative fee

5. Auction rights
The buyer will pay Bertolami Fine Arts an auction commission equal to 27% of the clearing price of each lot.
On lots purchased through online participation on the website www.bertolamifineart.com or on partner portals, an additional commission will be applied, quantified as follows:
www.bertolamifineart.com +1.5% of the clearing price
Bidspirit +1.5% of the clearing price
Drouot +3% of the hammer price
Invaluable +5% of the hammer price
Liveauctioneers +5% of the hammer price
One Bid +1.5% of the hammer price

6. Additional costs
Shipping costs, any customs costs, as well as the costs relating to the procedures to be instructed for the release of the certificate of Free Circulation or any prior ministerial authorization required for the export of the awarded lots are to be borne by the buyer.
In the event that, due to unjustified disputes, the goods should be returned to Bertolami Fine Art, the customs and shipping costs are charged to the customer.

7. Issuance of the certificate of Free Circulation or other ministerial authorization necessary for the export of the awarded goods
The delivery of the lots outside the Italian borders could be subject to the rules established by the Code of Cultural Heritage (Legislative Decree 42/2004 and subsequent amendments) regarding the export of goods of cultural interest. Therefore, in the event that the purchased good presents characteristics such as to require any form of ministerial authorization for its definitive exit from the territory of the Italian Republic, the times for issuing this authorization will be governed by the Office for the Export of Antiques and Art. art of the Ministry of Culture.

These release times must be calculated on average in the order of 60/90 days from the day of the opening of the file for a Certificate of Free Circulation (art.68 of the Code of Cultural Heritage) and 30 days for a Self-certification. The file is opened only upon payment of the goods and with the explicit authorization of the buyer.

8.Terms of sale
The conditions governing the relationship between Bertolami Fine Art and the kind customers who will take part in the auctions are published in each catalogue. Since they are automatically accepted from the moment of participation in the auction, please read them carefully.

9. Issuance of the certificate of Free Circulation or other ministerial authorization required for the export of the awarded goods
The delivery of the lots outside the Italian borders could be subject to the rules established by the Code of Cultural Heritage (Legislative Decree 42/2004 and ss.mm.ii.) regarding the export of goods of cultural interest. Therefore, in the event that the purchased good presents characteristics such as to require for its final exit from the territory of the Italian Republic any form of ministerial authorization, the timeframe for the issuance of such authorization will be regulated by the Office for the Export of Antiquities and Art Objects of the Ministry of Culture.
These issuance times should be averaged in the range of 60 to 90 days from the day the file is opened for a Certificate of Free Circulation (Art.68 of the Cultural Heritage Code) and 30 days for a Self-certification. The file is opened only upon payment of the property and upon explicit authorization of the buyer.

10. Conditions of Sale.
The conditions governing the relationship between Bertolami Fine Art and the kind clientele who will take part in the auctions are published in each catalog. Since they are understood to be automatically accepted from the moment of participation in the auction, please read them carefully.

11.Publication of auction results
The list of awards will be published by Bertolami Fine Art on its website, www.bertolamifineart.com, for information purposes only, within ten days of the auction closing.
